Term of service

Ordering and/or using MultipleCloud Services constitutes acceptance and agreement to MultipleCloud's TOS (Terms of Service), which has the legal binding value of a contract. The client agrees to indemnify and hold harmless MultipleCloud from any claims resulting from the use of our services.

We reserve the right to refuse service to anyone. Any material that, in our judgment, is obscene or threatening is prohibited and will be removed from our servers with or without notice.

Provision of Services
MultipleCloud will provide Client with the Services ordered that are described in the SEO Hosting Plan/Features after passing preliminary examination and validation of Client's provided details and payment by our automated fraud detection system or manually by our staff within the maximum period of no more than 2 working days. All suspected fraudulent orders shall be subjected for immediate account termination. MultipleCloud reserves the right to refuse any Client and/or withdraw any hosting plans, feature and specifications as advertised by providing at least 2-days written notice to affected Clients.

Client Information
Upon signing up with MultipleCloud, the client warrants that any information provided to MultipleCloud is entirely precise and accurate. MultipleCloud shall rely on all client information provided as primary contact info to contact and inform the client of any matter provided by MultipleCloud. In case the primary contact information has to be changed, the client must issue a written notice to MultipleCloud with updated contact details and then allow MultipleCloud at least 72 hours to put the changes into effect.

Payment and Fees
You agree to supply appropriate payment for the services received from MultipleCloud, in advance of the time period during which such services are provided. You agree that until and unless you notify MultipleCloud of your desire to cancel any or all services received, those services will be billed on a recurring basis. The billing cycle offerings currently stand at monthly, quarterly, semi annually, annually or otherwise if stated in the order form.

All payments must be made in USD (United States Dollars). The client is liable to keep all billing information on file with MultipleCloud up to date, and that all invoices are paid on time. MultipleCloud provides a 5 days grace period from the time the invoice is due and when it must be paid. Any invoice that is overdue for 5 days and not paid will result in a $10 late fee and/or an account suspension until account balance has been paid in full. MultipleCloud has policy to terminated account after 15 days of suspension if MultipleCloud do not receive any response from client.

Invoices that have been paid more than once with multiple Paypal Subscriptions can only be added as credit towards the account and cannot be refunded via Paypal.

Cancellation of Services
Client may cancel account at any time, for any reason or for no reason, by submit cancellation request in client area. A cancellation request is not considered received until it has been contacted to by an individual within our billing department. Automated email replies do not count. Our billing department will typically contact client who wish to cancel within one business day. All cancellation requests will be processed by our billing and account department manually to prevent any system errors. MultipleCloud requires a five (5) days cancellation notice prior to the billing date. Failure to supply the requisite five (5) days will result in a full billable monthly cycle prior to cancellation. All due amounts must be settled in full before we cancel the client account. Client understands and agrees that MultipleCloud does not provide pro-rated or any other kinds of refunds on cancellations. All fees Client has paid shall be non-refundable. All client's files and its database will be deleted after 30 days of cancellation. Clients can reactivate their account in this 30 days period without any charge.

Refund and Money back guarantee
Refunds will be given only at the discretion of MultipleCloud and generally not offered unless there are extraneous circumstances. MultipleCloud offers 7-day money-back guarantee on fees for hosting services. If for any reason you cancel your account within thirty (7) days starting from the day MultipleCloud dispatch your welcome email including your account information. MultipleCloud will refund your money with no questions asked; provided, however, that you have never previously obtained a refund under the 7-Day Guarantee. If you have ever previously obtained a refund under the 7-Day Guarantee, your account will be cancelled, and no money will be refunded to you.

Billing Cycles (Terms)
MultipleCloud offers four Billing Cycles (terms) for hosting charges: Monthly, Quarterly (3 months), Semi (6 months) and Yearly (12 months). The Billing Cycle may be prorated to the first of the next month.

You may elect to change your Billing Cycle at any time; however, the new Billing Cycle will only take effect at the time of the next plan renewal. All additional features added to an account are charged monthly. Additional items are non-refundable.

Account Renewals
In order to insure uninterrupted service to your website, all plans will automatically renew at the end of the plan's Billing Cycle. Plan renewal charges are based on the prevailing rate on the date of renewal according to the service selected. Plans are renewed for the same billing cycle.

Suspension and Termination of Services
MultipleCloud reserves the right to suspend any account suspected to be in violation of the TOS (Term of Service) or AUP (Acceptable Usage Policy). If inappropriate activity is detected, all accounts of the Client in question will be deactivated pending an investigation into the alleged violation. In the event of violation, the Customer acknowledges that no service credit or refund will be granted due to violations of the TOS or AUP. MultipleCloud further reserves the right to terminate the Client account set forth in this agreement in the event of a serious or repeated violation of this TOS or AUP without refund.

Zero Tolerance Spam and Abuse Policy
MultipleCloud take a zero tolerance stance against sending of unsolicited e-mail, bulk emailing, and spam. "Safe lists" and "double opt-in" will be treated as spam. Any user who sends out spam will have their account terminated with or without notice. MultipleCloud disclaims any liability in respect of client's website and all content that appears on client's website. We will try to monitor client's website to prevent abusive content as much as possible.

Sites advertised via SPAM (Spamvertised) may not be hosted on our servers. This provision includes, but is not limited to SPAM sent via fax, email, instant messaging, or usenet/newsgroups. No organization or entity listed in the ROKSO may be hosted on our servers. Any account which results in our IP space being blacklisted will be immediately suspended and/or terminated. You agree to pay a clean up fee of $30 per hour if any of our server IP addresses appear on a blacklist as a result of spam from your account.

MultipleCloud reserves the right to charge the holder of the account used to send any unsolicited e-mail a clean up fee. This cost of the clean up fee is entirely at the discretion of MultipleCloud.

Should MultipleCloud receive a notice of abuse (Copyright Infringement, Spam, Child Pornography, Hacking/Botnet/dDoS related events) or find violations of our terms of service relating to your server, MultipleCloud reserve the right to disable your account immediately or to make any such modifications in an emergency at its sole discretion. In most cases (depending on the severity) we will contact you first and give you a chance to respond within 24 hours.

Privacy Policy
None of the information you submit to us will be shared, sold, reused in lists, or be used for any other purpose than to complete your transaction or address a customer service concern.

Acceptable Usage Policy
MultipleCloud has a detailed Acceptable Usage Policy that can be found at: https://multiplecloud.com/aup. This policy is part of this Terms of Service, but and is only located at a different URL for convenience and readability.

Backups and Data Loss
Any and all backup services provided by MultipleCloud are offered with no warranty or guarantee of their date, accuracy, and integrity. MultipleCloud is not responsible for files and/or data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on MultipleCloud servers.

Changes to MultipleCloud's network
IP Address Changes or similar changes to MultipleCloud's network including, but not limited to software, hardware, staff, service providers, suppliers etc. may affect or interrupt services. MultipleCloud reserves the right to make changes to its network whenever it deems necessary without having to notify the customers who possibly might be affected by the amendment/change. MultipleCloud cannot be held liable for any harm caused to the customer resulting from downtime/interruption of service due to changes being made to MultipleCloud's network.

Scheduled Maintenance
MultipleCloud is constantly taking measures to ensure your service is better than ever. While every attempt to contact clients of scheduled maintenance, it is not always possible to notify clients if upgrades or hardware replacement are needed urgently.

Security and Password
You are solely responsible for maintaining the confidentiality of your password and account and for any and all statements made and acts or omissions that occur through the use of your password and account. Therefore, you must take steps to ensure that others do not gain access to your password and account. Our personnel will never ask you for your password unless it is necessary for resolve your problem. You may not transfer or share your account with anyone, and we reserve the right to immediately terminate your account if you do transfer or share your account.

Account Compliance and Security
The Client agrees to and acknowledges responsibility for the content or script hosted on their account. Any content or script found to be potentially harmful to MultipleCloud's server must be removed. Failure to comply with a MultipleCloud staff request for file removal may result in account suspension or termination.

All installed scripts and applications are advise to be kept up-to-date and upgraded to the latest versions. Client found running vulnerable versions of scripts are subject to suspension of their account to reduce the security threat to the server. Client are responsible for monitoring and securing access to their account, MultipleCloud is not responsible for unauthorized logins, use, loss, damages or costs incurred from a compromised Client account.

Price Change Policy
The amount you pay for hosting will never increase from the date of purchase. We reserve the right to change prices listed on MultipleCloud.com, and the right to increase the amount of resources given to plans at any time.

Disclaimer of warranties
MultipleCloud service is provided on an "as is", as available basis without warranties of any kind, either express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose or non-infringement. MultipleCloud expressly disclaims any representation or warranty that the MultipleCloud service will be error-free, secure or uninterrupted. No oral advice or written information given by MultipleCloud, its employees, licensor or the like, will create a warranty; nor may you rely on any such information or advice. MultipleCloud will not be liable for any cost or damage arising either directly or indirectly from any transaction or use of the service.

Limitation of Liability
MultipleCloud shall not be held liable for any losses, loss of potential profits caused to the client or any other party in connection with the client arising from services provided by MultipleCloud. MultipleCloud cannot be held responsible for any similar damage caused to the client on related party which could have been avoided by the use of reasonable diligence arising in connection with the agreement even if MultipleCloud has been advised or should be aware of possibility of such losses and damages. Client further acknowledges that the company's liability for its own negligence may not in any event exceed an amount equivalent to charges payable by subscriber for services during the period damages occurred. In no event shall the company be liable for any special or consequential damages, loss or injury.

MultipleCloud wishes to emphasize that in agreeing to Acceptable Usage Policy (AUP) and Terms of Service (ToS), the customer indemnifies MultipleCloud for any violation of the Acceptable Usage Policy (AUP) and Terms of Service (ToS) that results in a loss to MultipleCloud or the bringing of any claim against MultipleCloud by any third-party. This means that if MultipleCloud is sued because of a client's activity, the client will pay any damages awarded against MultipleCloud, plus all costs and attorney's fees.

Notification of Terms change
MultipleCloud is not required to notify clients of changes to these Terms of Service, Acceptable Usage Policy, or Privacy Policy. MultipleCloud will make an attempt to notify all clients of any changes made, but does not guarantee notification. Upon change of any terms listed above, the client is obligated to abide by those terms set and it is the Clients responsibility to periodically check the terms listed above for changes. The last date of modification is noted at the bottom of each document.
